ERISA long-term disability insurance claims are denied for many different reasons. However, this does not mean the insurance company is right. If your ERISA claim has been denied, you have the right to appeal the insurance company’s decision. But, you should move quickly. ERISA plans only allow you 180 days to file a denied claim appeal. If your ERISA long-term disability claim is denied, you must file an internal appeal with your insurance company before you challenge the decision in court. Generally, you have 180 days to file an appeal. It is critical that you make this deadline. If you miss your deadline, you may lose your chance to recover benefits.
Your insurance company must provide you with an electronic or written letter of denial. This letter should provide you with information about why your claim was denied based on your plan and evidence submitted. You may also request any relevant information from your insurance company about your claim.
